Peeping Tom Webshop Terms and Conditions

Please read these terms and conditions carefully before visiting or using our website. By visiting the website or using any part of it, you automatically agree to the terms and conditions.

In these Terms and Conditions, the following definitions shall apply:

  • 'Peeping Tom': Peeping Tom vzw, with registered address at Gabrielle Petitstraat 4/9, 1080 Sint-Jans-Molenbeek, registered under company number BE 0473 380 883.
  • 'Buyer' means any natural person (B2C) or legal entity (B2B) that is or will be in a contractual relationship of any kind with Peeping Tom.
  • 'Consumer': any natural person in the capacity of buyer acting for purposes outside its business or professional activity.
  • 'Products': The subject matter of one or more purchase agreements.
  • 'Sales contract' means any contract by which the trader undertakes to transfer ownership of goods and/or provide a service to the buyer. This buyer in turn undertakes to pay the price thereof.

In principle, these terms and conditions of sale shall always and exclusively apply, except in the case of an express deviation. An express deviation is valid only insofar as it is the result of mutual agreement expressly recorded in writing. Express deviations are valid only to replace or supplement the clauses to which they relate. The other provisions of these terms and conditions of sale shall remain in full force and effect in any event.

Peeping Tom reserves the right to amend and/or supplement the terms of sale at any time for future orders, without any prior notification. Any modification can be consulted on this page. Any future modification will obviously not affect existing orders and resulting agreements. Questions about the Terms and Conditions should be sent to us via shop@peepingtom.be.

Our webshop is hosted by Shopify Inc. They provide us with the online e- commerce platform that allows us to sell our products and services.

 

AGREEMENT

Peeping Tom takes the greatest care in posting online information on the characteristics of its products, based on data from its partners and suppliers, and with photographs illustrating the products. Certain non-substantial characteristics of a product may differ on delivery from the photos and description, as shown on the website.

An agreement is concluded the moment an order confirmation is handed to the buyer or, in case the offer is made via the website, by e-mail sent to the e-mail address provided by the buyer. Peeping Tom and the buyer expressly agree that by using electronic forms of communication, a valid agreement is established.

If it is not possible for Peeping Tom to execute the sales agreement (e.g. if a product is out of stock), Peeping Tom will notify the buyer within 15 days of the order being placed. In these cases, the buyer is in no case entitled to compensation.

 

PRICES

Only the prices on this website are valid. All prices are expressed in EUR and include VAT and other taxes. If an invoice is drawn up, it will be drawn up in EUR and is also payable in this currency.

The individual product prices indicated on the website are always displayed without additional costs such as shipping costs, customs fees, etc. Any additional costs shall also be borne by the buyer.

Prices are subject to change at any time. Peeping Tom undertakes to apply the current rates indicated on the website at the time of the sales agreement.

 

PAYMENT  

Customers have the option of paying by Bancontact, Maestro, Visa, MasterCard, American Express, Paypal, Google Pay, Apple Pay or Shopify Payments.

 

DELIVERY

We process every order promptly. In accordance with the Economic Code, the deadline for delivery is thirty (30) days after receipt of the order. Deliveries are made to the address specified by the buyer during the formation of the contract. Once the products to be delivered are delivered to the specified delivery address, the risk passes to the buyer. Delivery times may vary for areas outside the European Union.

Peeping Tom does everything within its power to meet the stated delivery deadlines. However, Peeping Tom takes no responsibility for deliveries that arrive late or for an order lost by third parties, due to unforeseen circumstances or force majeure. If an order is not delivered within the specified time, an investigation will be made with the carrier. This may take several days. During this period, no refund or reshipment can be made.

All costs related to the delivery of a sales contract shall be borne by the buyer, based on the prices indicated by the Belgian Post (De Post / La Poste), PostNL or DPD.

 

RIGHT OF WITHDRAWAL

Article vi47 Economic Law Code states that consumers can return the product within a period of fourteen (14) calendar days without any consequence - in terms of penalties or giving reasons. This is called the right of withdrawal.

The consumer who wishes to invoke the right of withdrawal must always do so expressly, unequivocally and compulsorily in writing. In doing so, it is up to the consumer to prove that he can invoke his right of withdrawal and must clearly communicate the following information to Peeping Tom:

  • The indication of the date of order, the date of receipt, and the date on which the right of withdrawal is exercised.
  • Name and address of the consumer
  • Consumer signature.

Any return must be sent by post or another carrier within fourteen (14) calendar days of using the right of withdrawal. Returning an order is at the expense and risk of the consumer. The items must be in perfect condition, in their original packaging. When the items are received again in perfect condition, their price will be refunded to the buyer's account within thirty (30) days.

 

DEFECTS AND COMPLAINTS

The buyer is always obliged to carefully examine the products immediately upon receipt. Complaints by the buyer, which relate to defects in the product or delivery and which are externally observable, must be notified in writing to Peeping Tom by the buyer within seven (7) days of delivery. In the absence of such notification, the buyer shall be deemed to have accepted the delivery as compliant. All returns are at the expense of the buyer. 

The buyer is not entitled to return the products about which there are no justified complaints. If the foregoing is not complied with, and goods are returned in error, all costs associated with the return shall be borne by the buyer.

 

FORCE MAJEURE

In case of force majeure, Peeping Tom is not obliged to fulfil its obligations to the other party. Peeping Tom is entitled to suspend its obligations for the duration of the force majeure. Force majeure means any force majeure independent of its will circumstance preventing the fulfilment of obligations towards the other party in whole or in part.

 

INTELLECTUAL PROPERTY

All intellectual property rights and derivative rights are retained by Peeping Tom vzw. These intellectual property rights include copyright, trademark, design and model rights and/or other (intellectual property) rights. The buyer is prohibited from using and/or modifying the intellectual property rights as described in this article, unless it is purely for private use of the product itself.

 

PROCESSING OF PERSONAL DATA

The information you provide is necessary for processing and completing orders, and preparing invoices. Customer data is only stored for this purpose unless you expressly consent, and will not be passed on to other parties. If this data is missing, the order will inevitably be cancelled. Providing incorrect or false personal data, will be considered a breach of the present general terms and conditions. The buyer can always request a copy of the personal data used by Peeping Tom to establish this sales agreement.

 

LAW AND JURISDICTION

All offers and agreements are governed exclusively by Belgian law. In the event of a possible dispute, both parties shall make every effort to resolve it out of court. If no agreement can be reached, only the Belgian courts will have jurisdiction.
